4. AI-Generated Content

All characters on Candy AI are entirely fictional and AI-generated. Any resemblance to real persons, living or deceased, is coincidental. Content generated through our platform is for entertainment purposes only and does not constitute real relationships or advice.

5. Subscription and Billing

Candy AI offers free and paid subscription tiers. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. Charges will appear on your bank statement as "EverAI". All prices are in USD unless otherwise stated. Local taxes may apply.

6. Intellectual Property

All content, software, and technology on Candy AI is owned by or licensed to EverAI Limited. You are granted a limited, non-exclusive, non-transferable licence to use the platform for personal, non-commercial purposes.

7. Privacy

Your use of Candy AI is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of Warranties

Candy AI is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of Liability

To the maximum extent permitted by applicable law, EverAI Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Candy AI.

10. Changes to Terms

We may modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or in-app notification.

11. Governing Law

These Terms are governed by the laws of Malta and, where applicable, the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malta.
